Minutes: Introduction of Ron DiPillo - New Principal of Oak Park - Steve Cantees

School Board/City Commission Discussion - The Board participated in a joint meeting last fall with the City of Sarasota where issues were brought forward; some issues related to facilities.  There were concerns related to student behavior and achievement.  We have moved ahead particularly those items in terms of how we can share some of our playground facilities at two of our elementary schools and perhaps looking at possible partnerships with the Robert Taylor site in terms of  Booker High School using that facility.  Steps have been made towards some of the things that the Board agreed that we needed to consider.    

Because there were not sufficient items for the Convocation of Government annual meeting it was not necessary to have this meeting.  There was a request made by the Commissioners of Sarasota City that they would like to meet again with the School Board to revisit some of those issues.  The Superintendent told the Commissioners that she would bring this to the Board's attention.  The Board agreed that if there is an agenda and issues that needed to be discussed then the Board should meet, but if there are not issues that need to be discussed and there is no agenda, the Board does not recognize a purpose for a meeting.  The Superintendent will go back to the person that made the initial request and ask if we could see a possible agenda and determine from that point after sharing with the Board members if the Board would like to pursue having another joint meeting this year, a later date or not at this time. 

Sometimes there are items that need to be discussed at a staff level and not a Board level.  The Board asked the Superintendent to filter through some of those items to see what items are really staff issues and issues that do not pertain to the work of the Board.

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

GENERAL ITEMS

9. DISTRICT ENGLISH LANGUAGE LEARNER (ELL/LEP) PLAN 2009-2011
Description
The District ELL/LEP Plan explains how educational opportunities and services are provided to English Language Learners in Sarasota County.


Recommendation
That the District ELL/LEP Plan be approved as presented.


10. REIMBURSEMENT OF ATTORNEYS' FEES
Description
Section 1012.26, Florida Statutes, provides in relevant part "The district school board shall provide for reimbursement of reasonable expenses for legal services for officers and employees of school boards who are charged with civil or criminal actions arising out of and in the course of the performance of assigned duties and responsibilities upon successful defense by the employee or officer." (emphasis added)  As a jury found Mr. Billa not guilty of the criminal offenses of which he was charged, and as those offenses arose directly out of his duties as a School Board employee, Florida law requires reimbursement of reasonable legal expenses.

Recommendation
That the School Board, pursuant to Section 1012.26, Florida Statutes, authorize reimbursement in the amount of $6,500.00 to Charles Billa for legal expenses he incurred in successfully defending a criminal action instituted against him for actions arising out of the performance of his assigned duties.

11. APPOINTMENT OF MR. PAUL MERCIER TO THE OVERSIGHT COMMITTEE FOR THE INTERLOCAL AGREEMENT ON SCHOOL FACILITY PLANNING
Description

The Interlocal Agreement on School Facility Planning, Section 10, calls for each party to appoint a citizen representative to a committee with responsibility to monitor implementation of the ILA.  The most recent representative resigned earlier this Fall, and the Board considered a replacement.



Recommendation

That the School Board of Sarasota County appoint Mr. Paul Mercier as its representative to the Citizen's Oversight Committee to the Interlocal Agreement on School Facility Planning for a period through February, 2012.



12. APPROVAL OF SETTLEMENT AGREEMENT FOR DRAINAGE EASEMENTS AND QUIT CLAIM DEED FOR HONORE AVENUE PROJECT
Description

Sarasota County Government is undertaking the improvement of Honore Avenue from Bee Ridge Road to Fruitville Road, including sidewalks, roadway and drainage improvements. This agreement authorizes three easements on Honore Avenue and a quit claim deed for property along Honore Avenue and at the corners of Porter Street and Sawgrass Road all of which are adjacent to Fruitville Elementary School. These will be granted by the School Board to the County for a negotiated sum of $32,927.00, which was determined by an August 2009 appraisal. Approval of this agreement will allow the County to complete the improvements to Honore Avenue and will not negatively affect campus operations. The majority of Phase II of the project, in front of Fruitville Elementary, will occur during the summer of 2010.



Recommendation

That the School Board of Sarasota County approve the settlement agreement granting the easements and conveyance of the quit claim deed to Sarasota County as presented.

13. SETTLEMENT OF LITIGATION
Description
Approval of the Settlement Agreement and Release and Purchase and Sale Agreement will conclude the educational impact fee litigation instituted by Palmer Ranch Holdings, Ltd. with Palmer Ranch dismissing its complaint and providing the School Board and Sarasota County with a release of claims.

Recommendation
That the School Board approve the following documents as presented: (1) the Settlement Agreement and Release resolving all claims made in the case of Palmer Ranch Holdings, Ltd. v. Sarasota County et al., Case No. 2005 CA 006686 NC in the Twelfth Judicial Circuit Court; and (2) the Purchase and Sale Agreement selling real property to Palmer Ranch Holdings, Ltd. as part of the settlement agreement on the terms described in the Purchase and Sale Agreement.

14. SETTLEMENT OF LITIGATION
Description

In exchange for the payment described below, the plaintiff will execute a release in favor of the School Board and dismiss her complaint with prejudice thereby ending the litigation and resolving all claims.



Recommendation
That the School Board approve payment of $12, 280.92 to the Trust Account of Zimmerman and Zimmerman, P.A. to settle all claims in the case of Mary Burton v. Sarasota County School Board, Case No. 2008 CA 20006 NC in the Twelfth Judicial Circuit Court.

AGREEMENTS/CONTRACTS

15. APPROVAL OF AGREEMENT BETWEEN SOUTH COUNTY FAMILY YMCA AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, TO PROVIDE CHILD CARE SERVICES
Description
The South County Family YMCA agrees to provide child care services in conformance with 65C-22, Florida Administrative Code, "Child Care Standards" at Laurel Nokomis School.

Recommendation
That the agreement with South County Family YMCA to provide child care service at Laurel Nokomis School be approved as presented.

16. HEALTHSOUTH CLINICAL AFFILIATION AGREEMENT 2009-10
Description
This agreement is between the School Board of Sarasota County, Florida, and HealthSouth Corporation.  HealthSouth owns and operates a national network of rehabilitation hospitals and other healthcare facilities throughout the United States; the School offers its students a degree or certification program in the field of nursing, therapy, pharmacy or other clinical care and treatment; both parties agree that it is to their mutual advantage for selected students of the school to receive clinical education experience at a HealthSouth hospital.

Recommendation
That the HealthSouth Clinical Affiliation Agreement be approved.

17. AFFILIATION AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA, FLORIDA, AND PEACE RIVER REGIONAL MEDICAL CENTER
Description
The School Board offers to enrolled students a Health Science program; and Health Care Facility manages a health care facility; and the School Board desires to provide to its students a clinical learning experience through the application of knowledge and clinical skills in actual patient-centered situations in a health care facility; and Health Care Facility has agreed to make its facility available to School Board for such purpose.

Recommendation
That the Affiliation Agreement between the School Board of Sarasota, Florida, and Peace River Regional Medical Center be approved.

18. APPROVAL OF SETTLEMENT AGREEMENT AND RELEASE
Description
Sam Rodgers Properties, Inc. is the developer of the Hatchett Creek at Jacaranda DRI.  Prior to the imposition of educational impact fees and as a condition of the DRI, Rodgers made a cash donation of $350,000 to the School Board to offset expected educational impacts of the development.  Subsequently, the educational impact fee ordinance was enacted, including a provision for credits/reimbursement for prior, pre-impact fee contributions.  Rodgers has sought reimbursement and the settlement agreement reimbursing Rodgers the amount of $165,000 has been negotiated by counsel for the School Board and Rodgers.

Recommendation
That the School Board approve the Settlement Agreement and Release with Sam Rodgers Properties, Inc. as presented.

19. APPROVAL OF THE CONTRACT FOR EDUCATIONAL SERVICES BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND POSITIVE BEHAVIOR INTERVENTIONS INC.
Description
Positive Behavior Interventions Inc., will provide Board Certified Behavior Analyst to assist team of severe social/emotional behavioral disordered students in developing and analyzing a plan to implement instructional programs.

Recommendation
That the contract for behavior intervention services between the School Board of Sarasota County, Florida, and Positive Behavior Interventions, Inc., in the amount of $100,000, be approved as presented.

GRANTS

20. APPROVAL OF THE EDUCATION CHANNEL EXCELLENCE IN OPERATION GRANT PROPOSAL TO THE GULF COAST COMMUNITY FOUNDATION OF VENICE
Description
COMPETITIVE: Grant funds of $68,000 will allow the Education Channel to continue to deliver on its mission.

Recommendation
That the School Board of Sarasota County approve The Education Channel Excellence in Operation grant proposal.

21. APPROVAL OF THE WONDERFUL WATER WORKS GRANT PROPOSAL TO THE SPLASH! GRANT PROGRAM FROM THE SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT TO BROOKSIDE MIDDLE SCHOOL
Description
COMPETITIVE: Grant funds of $3,005 will help students understand how we use water and its importance in our lives today.

22. APPROVAL OF THE WATERSHED AND ENVIRONMENTAL TEACHER TRAINING GRANT PROPOSAL TO THE NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION FOR ALL SARASOTA HIGH SCHOOLS
Description
COMPETITIVE: Grant funds of $47,397 will create a high school teacher training program focused on watershed and environmental issues.

FIELD TRIPS

26. APPROVAL OF THE PINE VIEW SCHOOL SPEECH & DEBATE FIELD TRIP TO BOSTON, MASSACHUSETTS, ON FEBRUARY 12, 2010 THROUGH FEBRUARY 16, 2010
Description
Students of Speech I and Debate II classes compete in district, state, and national speech and debate contests.  All high school students, regardless of economic level, are invited to participate and belong to the Speech and Debate team by competing in speaking contests.  They earn membership privileges in the Catholic Forensic League, Florida Forensic League, and National Forensic Leagues.

Recommendation
That the Pine View School Speech and Debate field trip to Boston, Massachusetts, on February 12, 2010 through February 16, 2010, be approved.

27. APPROVAL OF THE AMIKIDS INFINITY SARASOTA FIELD TRIP TO ATLANTA, GEORGIA, JAN 14-16, 2010
Description
The students will have the opportunity to learn important facts about black history and the life and legacy of the Rev. Dr. Martin Luther King, Jr. through exploration of the King Center.  Additionally, there will be a behind the scenes tour of the CNN Global Headquarters, and a visit to "The World of Coca-Cola".

Recommendation
That the AMIKids Infinity Sarasota field trip to Atlanta, Georgia, on January 14-16, 2010, be approved.

28. APPROVAL OF THE SARASOTA HIGH SCHOOL GRAPHIC DESIGN AND JOURNALISM FIELD TRIP TO NEW YORK CITY, NEW YORK, ON MARCH 16, 2010 THROUGH MARCH 19, 2010
Description
Sarasota High newspaper and yearbook students will participate in the annual Columbia Scholastic Press Association Convention at Columbia University in New York City.  Columbia Graduate School sponsors this event.  Students will have the opportunity to participate in over 300 possible sessions that will run simultaneously throughout the convention.  The CSPA convention is an international convention uniting student journalists and faculty advisers through educational seminars, idea exchanges and awards programs.  Additionally, students will visit various locations of interest in New York City.

Recommendation
That the Sarasota High School Graphic Design and Journalism field trip to New York City, New York, on March 16, 2010 through March 19, 2010, be approved.

29. APPROVAL OF THE SARASOTA HIGH SCHOOL SPEECH & DEBATE TEAM FIELD TRIP TO CAMBRIDGE, MASSACHUSETTS, ON FEBRUARY 12, 2010 THROUGH FEBRUARY 16, 2010
Description
This is a competitive Speech and Debate team which competes in 10 separate events at each tournament.  It is connected directly to the Speech and Debate courses offered at Sarasota High School as well as the National Forensic League, National Catholic Forensic League, and the Florida Forensic League.

Recommendation
That the Sarasota High School Speech and Debate team field trip to Cambridge, Massachusetts, on February 12, 2010 through February 16, 2010, be approved.

EXPULSIONS

30. APPROVAL OF EXPULSION CASE NO. 10-102
Description

The student listed in Expulsion Case No. 10-102, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 20, 2009, the student listed in Expulsion Case No. 10-102, violated School Board Policy 5.34(1)(d), Fighting/Disruption.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 24, 2010.



Recommendation

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-102, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year, the 2010 summer session until August 24 of the 2010-2011 academic year.

Description

Description

Description

The student listed in Expulsion Case No. 10-003, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On May 29, 2009, the student listed in Expulsion Case No. 10-003, violated School Board Policy 5.34(1)(d), Theft.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2010.



Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 10-003, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2009-2010 academic year.

Description

School Board Policy 5.34(4) permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in the Sarasota County Adult High School.

Description

Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable. Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.

43. RATIFICATION OF AMENDMENT #14 TO THE ARCHITECT'S AGREEMENT DATED 9/20/2005 FOR THE DESIGN OF THE RIVERVIEW HIGH SCHOOL PROJECT
Description

This amendment provides for the additional services required to providing information and documentation to the "Save Paul Rudolph" group as well as changes to the layout and services to the Performance Based Diploma portables located in the northeast corner of the campus.  This change was required by Sarasota County to save several "grand" trees.  The cost of this amendment is $15,300.00.  Funds are available in the project budget account.

The scope shall be to provide civil engineering services for minor projects, district-wide, as assigned.  These projects are defined as those with a construction cost of less than $250K and consultant fees of less than $25K.  On 12/4/2009, the Professional Services Selection Committee (PSSC) met to select certified and qualified engineering firms for this continuing services contract.  The PSSC has ranked them in accordance with School Board Policy #7.71.  The estimated cost of these services for the three-year period is $100,000.00.  Funds for these services are available through individual project accounts.

Description

This interlocal agreement details the conditions under which the School Board and the City of Venice will partner to upgrade an auditorium at Venice High School to a Performing Arts Center, as part of the rebuild project on the Venice High School campus.  The agreement specifically lays out funding parameters, including a payment schedule for the $7,500,000 the City of Venice agrees to pay the School Board for the required upgrades, and the use priorities of the Center once complete.

79. APPROVAL OF THE JOINT USE AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY AND THE CITY OF VENICE
Description

This agreement lays out the condition under which the jointly funded Venice Performing Arts Center will be used.  It set use priorities as follows:  In general, the City and School Board agree that the following priority order of uses and users is hereby established: 1) students and School Board-related activities; 2) the Venice Symphony, the Venice Concert Band and the Exsultate Venice Chorale (collectively referred to as "The Performing Arts Organizations" (PAO); 3) City of Venice events and activities; 4) other Venice community based groups and events; and 5) all other groups.  The agreement also details use conditions and fee structures.  While acted upon in conjunction with the Venice Performing Arts Center Interlocal Agreement joint use will not commence until completion of the Performing Arts Center itself scheduled to be complete by December 31, 2014.

80. APPROVAL OF THE MEMORANDUM OF UNDERSTANDING TO PARTICIPATE IN THE STATE'S RACE TO THE TOP GRANT APPLICATION
Description

The Memorandum of Understanding is a required component of the Florida Department of Education Race to the Top grant application. Districts that wish to be a participating district must indicate their agreement to implement key elements described in Exhibit 1 – Preliminary Scope of Work. Implementation of many of the key elements would be dependent upon successful negotiations of the collective bargaining agreement. Fifty percent of the funds received by a successful state application would be distributed to those districts that have a signed MOU and have negotiated the required elements in the collective bargaining agreement. It is estimated that the district could receive approximately $4,000,000 or more (distributed over a 4 year period) if it meets the criteria of a participating district. The funds are to be used to support the grant related activities required to meet the key components outlined in Exhibit 1.



Recommendation

To authorize the Superintendent and the Chairperson of the School Board to sign a Memorandum of Understanding to participate in the state’s Race to the Top grant application as presented.
